Terms of Service
These terms govern access to Linguistic Communication's website and optional digital tools, including tools that connect an authorised social-media account for content publishing.

1. Provider and acceptance
The services covered by these terms are provided by LINGUISTIC COMMUNICATION (SIREN 880433222; SIRET 88043322200010), trading as Linguistic Communication, at 3 rue des Groseilliers, 93100 Montreuil, France. You can contact us at linguistic.com@gmail.com or +33 6 75 08 12 01.
By using this website or an optional digital tool we provide, you agree to these terms. If you use a tool on behalf of a school, company, client, or social-media account owner, you confirm that you are authorised to bind that organisation or owner for the relevant use. If you do not agree, do not use the service.
2. Website information and enquiries
The website presents teaching delivery, curriculum, assessment, instructor, TOEIC, and related educational services. Website descriptions, guides, course outlines, diagnostic results, and indicative information are provided for general information and do not by themselves create a contract, guarantee availability, or promise a particular academic, examination, employment, or business result.
Sending an enquiry, completing a diagnostic, or booking a meeting is a request to discuss services. A binding engagement begins only when the parties accept a proposal, order, convention, contract, or other written agreement. That agreement controls if it conflicts with these general website terms.
3. Eligibility and authorised accounts
Business enquiry and social-publishing functions are intended for adults and authorised representatives of organisations. You must provide accurate information, use only accounts and content you are authorised to control, and keep any login, device, or connected-platform credentials secure. You must notify us promptly if you believe access has been compromised.
A minor may use educational content only with any supervision or consent required by law, their school, or their parent or guardian. Minors may not connect a social-media account through our tools unless expressly authorised and permitted by the relevant platform.
4. Social-media and TikTok publishing tools
If we make a TikTok or other social-platform connection available, it lets an authorised user link an account and ask us to process selected content for scheduling, publication, status confirmation, or troubleshooting. Connecting an account does not transfer ownership of that account or its content to us.
- You must be authorised by the account owner to connect the account and publish each item.
- You are responsible for captions, media, claims, music, people depicted, privacy choices, audience settings, disclosures, and all necessary rights, licences, releases, and consents.
- You must review content and settings before approving publication. A scheduled time is a requested target, not a guarantee, because platform review, rate limits, outages, or policy checks may delay or reject a post.
- You must comply with TikTok's or the relevant platform's terms, community guidelines, developer rules, advertising rules, and technical limits in addition to these terms.
You grant Linguistic Communication a limited, non-exclusive licence to host, copy, format, transmit, and otherwise process submitted content only as needed to provide the requested publishing function, maintain security, and comply with law. This licence ends when the content is deleted from our systems, subject to limited backups and records we must retain.
5. Acceptable use
You must not use the website or tools to:
- access, connect, impersonate, or publish from an account without authorisation;
- infringe copyright, trade marks, image rights, privacy, confidentiality, publicity rights, or other rights;
- publish unlawful, deceptive, discriminatory, harassing, defamatory, unsafe, exploitative, or malicious material;
- send spam, manipulate engagement, mislead users about sponsorship, or evade platform safeguards;
- upload malware, probe for vulnerabilities without written authorisation, disrupt service operation, bypass access controls, or reverse engineer protected parts of the service except where the law expressly permits;
- submit personal or confidential data without a lawful basis and the permissions required for that data;
- use the service in a way that violates applicable law or a connected platform's rules.
We may reject, pause, or remove content and suspend access when reasonably necessary to address security, rights, legal, or platform-compliance concerns.
6. Intellectual property
Linguistic Communication and its licensors retain rights in the website design, software, branding, original course material, guides, and other service content. Except where a separate licence or contract says otherwise, you may view and use public website material for personal or internal evaluation only. You may not reproduce, sell, republish, scrape at scale, or create competing materials from protected content without permission.
You retain rights in content you submit. You confirm that our limited processing of that content under these terms will not violate another person's rights or an obligation owed to a school, employer, client, or platform.
7. Third-party services
The service may link to or interoperate with third parties such as TikTok, Google, Cal.com, email providers, and hosting providers. Their services are governed by their own terms and privacy notices. We do not control their availability, moderation decisions, account restrictions, data practices, or changes to their APIs. TikTok and other third-party names and marks belong to their respective owners; their integration does not imply endorsement of Linguistic Communication.
8. Availability and changes
We aim to operate the website and digital tools with reasonable care, but access may be interrupted for maintenance, security work, provider outages, platform changes, or events outside our reasonable control. We may modify or discontinue a feature when needed, including when a connected platform changes or withdraws an API. Where a material change affects a contracted paid service, the applicable contract governs available remedies.
9. Fees and paid services
Public website access is generally free. Fees, taxes, payment dates, cancellation rights, deliverables, and refund terms for teaching, programme, consulting, or managed publishing services are stated in the relevant proposal, order, convention, invoice, or contract. You remain responsible for charges imposed directly by a third-party platform or service under your own account.
10. Responsibility and liability
Each party is responsible for losses it causes by breaching its legal or contractual obligations. To the extent permitted by law, Linguistic Communication is not responsible for indirect or unforeseeable losses, lost opportunities, lost profits, or third-party platform decisions arising from free website use or an interrupted third-party integration. We are not responsible for content, settings, rights, or account access supplied or approved by a user.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, or personal injury where applicable. Any liability limit in a signed client contract applies to that contracted service. Mandatory consumer rights remain unaffected.
11. Suspension, disconnection, and termination
You may stop using the website at any time and may revoke a connected TikTok or other platform authorisation through that platform's settings. You may also ask us to disconnect and delete eligible connected-account data as described in our Privacy Policy.
We may suspend or terminate access where reasonably necessary for security, non-payment under a separate agreement, serious or repeated breach, suspected unauthorised use, legal compliance, or a third-party platform requirement. Provisions that by their nature should survive termination, including ownership, payment obligations, responsibility, and legal claims, continue to apply.
12. Privacy
Our Privacy Policy explains what personal data we collect, why we use it, retention, recipients, international transfers, rights, and how to request deletion of connected TikTok data.
13. Governing law and disputes
These terms are governed by French law. The parties should first try to resolve a dispute in good faith by contacting linguistic.com@gmail.com. If no resolution is reached, competent French courts may hear the dispute, subject to any mandatory jurisdiction, consumer protection, or mediation rights that apply.
14. Changes and severability
We may update these terms to reflect service, platform, security, or legal changes. The current version is identified by the effective date above. Material changes affecting active authorised users will be communicated through an appropriate service channel when reasonably possible. If a provision is held unenforceable, the remaining provisions continue to apply.
